These Terms of Service ("Terms") govern your use of Motofly ("we", "us", "Motofly"), accessible at motofly.co.uk (the "Service"). By creating an account or using the Service you agree to be bound by these Terms.

1. About Motofly

Motofly is an online marketplace that connects buyers and sellers of used motor vehicles in the United Kingdom. We do not own, sell, inspect, or warrant the vehicles listed on the Service. Any contract for the sale of a vehicle is made directly between the buyer and the seller, and Motofly is not a party to that contract.

2. Eligibility

To use the Service you must:

  • be at least 18 years old;
  • have legal capacity to enter into a binding contract;
  • provide accurate, current, and complete information when creating an account; and
  • keep your account credentials confidential. You are responsible for all activity that occurs under your account.

3. Listings

If you list a vehicle for sale you confirm that:

  • you are the legal owner of the vehicle, or you are an authorised dealer acting on the owner's behalf;
  • the listing is accurate, complete, and not misleading, including in respect of mileage, MOT status, history, damage, modifications, and outstanding finance;
  • the sale of the vehicle would not contravene any UK law, including the Consumer Rights Act 2015, the Sale of Goods Act 1979 (where applicable), and the Consumer Protection from Unfair Trading Regulations 2008; and
  • you own or have permission to use all photos and content you upload.

By submitting content to the Service you grant Motofly a worldwide, non-exclusive, royalty-free licence to host, display, and distribute that content for the purposes of operating and promoting the Service.

4. Prohibited use

You agree not to:

  • list stolen, cloned, or unregistered vehicles;
  • list vehicles with undisclosed insurance write-off category, outstanding finance, or material damage;
  • post content that is unlawful, fraudulent, defamatory, obscene, discriminatory, or that infringes the rights of others;
  • use the Service to send spam, phishing attempts, or any other form of unsolicited commercial communication;
  • attempt to gain unauthorised access to the Service, other users' accounts, or our infrastructure; or
  • scrape, copy, or otherwise extract data from the Service without our prior written consent.

5. Buyer responsibilities

You are solely responsible for satisfying yourself as to the condition, history, and provenance of any vehicle before purchase, including (where appropriate) commissioning a professional inspection, an HPI check, and verifying the seller's identity and documentation. Motofly does not guarantee the accuracy of any listing.

6. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all implied warranties, conditions, and other terms that may otherwise apply, including in relation to merchantability, fitness for purpose, and the accuracy or completeness of any listing.

7. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.

Subject to the above, Motofly is not liable to you for any loss or damage arising out of or in connection with: (a) any transaction between you and another user; (b) the condition, quality, legality, or accuracy of any listing; or (c) any indirect, consequential, or special loss, including loss of profits, business, or anticipated savings.

8. Suspension and termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have breached these Terms or that your continued use of the Service poses a risk to other users. You may close your account at any time by contacting info@motofly.co.uk.

9. Changes to the Service or these Terms

We may modify the Service or these Terms at any time. We will update the "last updated" date and, where the changes are material, provide reasonable advance notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

10. Governing law

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may bring proceedings in your local courts.
